What U.S.-Based Collectors Need to Know

As of now, original artworks and photographs remain exempt from recently announced tariffs on U.S. imports.

This exemption is grounded in U.S. law, specifically, the latest tariffs enacted in April 2025 under the International Emergency Economic Powers Act (IEEPA)—a statute that explicitly prohibits restrictions on cultural and informational materials. This includes original artworks, prints, photographs, and other expressive works.

This exemption is not incidental—it’s rooted in longstanding protections for free expression under the U.S. Constitution. Specifically, it is tied to First Amendment protections that ensure the free flow of cultural and informational materials, including original artworks, is preserved and celebrated.

While some countries have responded to U.S. trade policy with their own tariffs—including, in some cases, duties on U.S.-origin artworks—this does not affect shipments coming into the United States.
